Project terms
AI-assisted delivery of services
isiomedia delivers all services with the support of artificial intelligence. This includes project analysis, the review of documents and the creation of design and marketing materials. Content provided by the client (texts, photos, logos, brand materials) will be processed by AI systems. By commissioning a project, the client expressly agrees to this approach.
Data & privacy
Only data provided by the client or publicly available data is processed. The legal basis is the performance of a contract pursuant to the GDPR. Further details are set out in the privacy policy.
Usage rights
Upon full payment, the client receives unrestricted usage rights to all created content for the agreed purposes. For individually developed websites, web tools and portals, the client receives the work results including source code for unrestricted use. As content is created with the support of AI systems, no copyright warranty vis-à-vis third parties is provided. isiomedia accepts no liability for third-party claims, to the extent permitted by law.
Websites, web tools & portals
Websites, web tools and portals are developed in line with current best practice and tested in current standard browsers. Upon handover, responsibility for the work results passes to the client; hosting, operation and maintenance are not part of the project scope unless agreed separately. Open-source components used are subject to their respective licences.
Liability
isiomedia is liable for the diligent delivery of the agreed services. Liability for consequential damages or lost profits is excluded. No responsibility is accepted for the accuracy or legality of content provided by the client.
Content and legal texts of the client's own website
The client remains responsible for the content and legal aspects of their own website (e.g. imprint, privacy policy, industry-specific mandatory information). This also applies to the setup and operation of a cookie consent tool, where one is required. isiomedia does not provide legal advice.
Commercial outcomes
Concepts and measures are created to the best of professional knowledge. A specific commercial outcome, such as search engine rankings, visitor numbers or revenue, is not guaranteed.
Pricing
Quotes are prepared individually on the basis of the respective project scope. All stated prices are net amounts plus applicable VAT.
Client cooperation
The client shall provide necessary documents, materials, access and feedback promptly. Delays caused by missing or late client input have no effect on the fee entitlement.
Third-party services
Costs for third-party services (e.g. hosting, domains, licences, stock material) are borne by the client and are agreed in advance.
Acceptance
Delivered content, drafts and work results are deemed approved unless the client notifies isiomedia in writing of specific defects within 5 working days of receipt.
Payment terms
Work commences upon receipt of payment or an agreed deposit. isiomedia reserves the right to pause work until all payments and required materials have been received in full.
AI tools and third-party data
If the client provides data containing personal information of third parties, the client is solely responsible for informing those persons in advance about the processing by AI systems. isiomedia accepts no liability in this regard.
Revisions
Two rounds of revisions per service package are included in the agreed project price. Further change requests that go beyond factual corrections or extend the original project scope will be invoiced separately on a time-and-materials basis.
References
isiomedia may name and show completed projects as references to a reasonable extent, unless the client objects. Confidential content is excluded.
Partners
isiomedia may involve carefully selected partners in delivering the services. Responsibility for the agreed services remains with isiomedia.
Training & workshops
For booked training sessions and workshops, cancellations are free of charge up to five working days before the agreed date. Cancellations after this point will be invoiced at the full agreed fee. Rescheduling is possible by agreement, subject to availability.
